By making a purchase from a TCG Wagon vending machine, you agree to these Terms & Conditions.
TCG Wagon is the trading name of Vault Collectables Limited.
1. Products
- All products sold through our vending machines are supplied sealed and unopened.
- Our vending machines may stock Pokémon Trading Card Game products and other trading card products and accessories.
- Trading card products can contain randomised contents. The contents of an individual pack, box or product are determined by the manufacturer and are not selected or guaranteed by TCG Wagon.
- For this reason, we cannot offer refunds, exchanges or compensation based solely on the cards or contents received from a sealed product, including where a customer does not receive a particular card, rarity, character or value they were hoping for.
- Nothing in these Terms & Conditions affects your statutory rights where a product is faulty, incorrectly described or otherwise does not meet the requirements of applicable consumer law.
2. Product Availability & Pricing
- Product availability, selection and pricing may vary between vending machines and locations.
- Products may sell out without notice, and we may change the products or prices available in our machines from time to time.
- The price displayed on the vending machine at the time of purchase will apply to that transaction.
3. Vending Machine Purchases
- Our vending machines are designed to dispense the products selected and paid for by the customer.
- Once payment has been successfully authorised, the machine will attempt to dispense the selected product.
- Customers should check the collection area of the vending machine after each purchase to ensure that the product has been dispensed successfully.
- If a product does not dispense, appears to be stuck, or the number of products dispensed is different from the number purchased, please contact TCG Wagon as soon as reasonably possible and provide details of the transaction.
- Where appropriate, we may ask for information such as the date and time of the purchase, vending machine location, product selected, transaction amount and evidence of the transaction.
4. Products Not Dispensed / Partial Orders
- Occasionally, a product may fail to dispense correctly due to a mechanical issue or the product becoming caught within the vending mechanism.
- If you purchase multiple products and one or more products are successfully dispensed but another product is not, we will investigate the issue and, where we establish that the product was not received, we will refund the value of the product that was not dispensed.
- For example, if a customer purchases three individual packs and two packs are successfully dispensed but one pack is not, the refund will normally be for the value of the one pack that was not received, rather than the full value of the three-pack transaction.
- Customers are not required to return products that were successfully dispensed simply because another product in the same transaction failed to dispense, unless we specifically agree otherwise.
- This does not limit or exclude any rights a customer may have under applicable consumer law.
5. Refunds
- Where a refund is approved, we will normally refund the amount relating to the product or products that were not received.
- Refunds will generally be made using the original payment method where this is possible. Where this is not possible, we may request alternative payment details from the customer.
- We may request reasonable information or evidence to help us investigate a refund request, particularly where we need to verify the transaction or determine whether a product was successfully dispensed.
- We reserve the right to investigate suspected fraudulent, dishonest or abusive refund claims.
- Nothing in these Terms & Conditions removes or restricts any statutory rights that you have as a consumer.
6. Incorrect Products
- If a vending machine dispenses a different product from the one selected and paid for, please contact us as soon as possible.
- We will investigate the issue and, where appropriate, arrange a suitable remedy in accordance with applicable consumer law.
- Customers should not attempt to dismantle, open, move or interfere with the vending machine in order to retrieve a product.
7. Randomised Trading Card Products
- Trading card products, including Pokémon Trading Card Game products, may contain randomised cards and contents.
- We do not guarantee the presence of any particular card, rarity, character, artwork, value or pull rate unless expressly stated by the manufacturer.
- A customer receiving an undesirable or lower-value card does not, by itself, constitute a fault with the product.
- Refunds will not be provided simply because a customer is unhappy with the random contents of a sealed product.
8. Damaged or Faulty Products
- If a product appears to be damaged, defective or otherwise faulty when purchased, please contact us with details of the issue.
- We will assess the issue and provide an appropriate remedy where required by applicable consumer law.
- Customers should not open or alter a product where doing so could affect our ability to investigate a reported fault, unless necessary to identify the issue.
9. Payment Issues
- All payments must be successfully authorised before a product can be dispensed.
- Payment processing is handled through our payment provider. TCG Wagon is not responsible for temporary payment-provider, banking, card-network or telecommunications issues outside our reasonable control.
- If your payment appears to have been taken but the vending machine does not dispense the selected product, please contact us so that we can investigate the transaction.
10. Machine Operation & Technical Issues
- Our vending machines rely on electricity, telecommunications networks, payment systems and other technology to operate.
- We will make reasonable efforts to keep our machines operational and stocked, but we cannot guarantee uninterrupted availability.
- Occasional technical faults, network interruptions, power outages, payment-provider issues, stock shortages or other circumstances outside our reasonable control may affect the operation of a machine.
- Where a technical issue results in a customer not receiving a product they have paid for, we will investigate the matter and provide an appropriate remedy where required.
11. Customer Conduct & Machine Interference
Customers must not:
- attempt to open, dismantle or damage a vending machine;
- insert objects into areas of the machine that are not intended for customer use;
- shake, hit, kick, push or otherwise interfere with a vending machine;
- attempt to bypass or interfere with the payment system;
- attempt to retrieve products using objects or other methods;
- deliberately cause damage to the machine or its components; or
- engage in fraudulent activity relating to a purchase or refund.
Any deliberate damage, tampering or interference may be reported to the relevant shopping centre, property management company or appropriate authorities, and we reserve the right to seek recovery of losses caused by deliberate damage or misuse.
12. Lost, Damaged or Removed Products
- Once a product has been successfully dispensed and collected by the customer, TCG Wagon cannot be responsible for products subsequently lost, damaged or discarded by the customer.
- Customers should check their products before leaving the vending machine area and keep their receipt or transaction information where available.
- This does not affect any statutory rights relating to products that are faulty or otherwise do not conform to the contract.
13. Evidence & Transaction Information
To help us investigate a vending machine issue, we may request reasonable information relating to the purchase. This may include:
- date and approximate time of purchase;
- vending machine location;
- product purchased;
- amount paid;
- transaction reference or receipt;
- photographs or video of the issue; and
- other information reasonably required to investigate the matter.
We may use transaction records and machine records to assist with investigating vending issues and refund requests.
14. Fraudulent or Abusive Claims
- We take customer complaints seriously and aim to resolve genuine vending machine issues fairly.
- However, we may investigate claims where there is evidence or reasonable suspicion of fraud, deliberate misuse, repeated abusive refund requests, tampering or other dishonest behaviour.
- We may decline a refund where a claim is found to be fraudulent or where there is reasonable evidence that the customer received the product claimed to be missing.
- This does not affect any statutory rights that cannot legally be excluded or restricted.
15. Website Purchases
- Where products are purchased through the TCG Wagon website rather than a vending machine, the terms applicable to website orders will also apply.
- Information relating to delivery, returns, cancellations and refunds for website purchases will be provided to customers where applicable.
- Nothing in these Terms & Conditions is intended to remove any cancellation, refund or other rights that apply to consumers under UK law.
16. Limitation of Liability
- Nothing in these Terms & Conditions excludes or limits our liability where doing so would be unlawful.
- In particular, nothing in these Terms & Conditions excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.
- Subject to the above, we will not be responsible for losses that are not reasonably foreseeable or that arise from circumstances outside our reasonable control.
17. Changes to These Terms
- We may update these Terms & Conditions from time to time to reflect changes to our business, vending machines, services or applicable legal requirements.
- The version applicable to a purchase will be the version in effect at the time of that purchase, unless a change is required by law.
18. Statutory Rights
- These Terms & Conditions are not intended to affect or restrict your statutory rights as a consumer.
- Where applicable, consumers have legal rights relating to goods being as described, of satisfactory quality and fit for purpose.
- Nothing in these Terms & Conditions prevents a customer from exercising rights provided by applicable consumer protection legislation.
19. Contact Us
If you experience an issue with a TCG Wagon vending machine or have a question regarding a purchase, please contact us through social media or on info@tcgwagon.com.
When contacting us about a vending machine purchase, please provide as much information as possible so that we can investigate the matter promptly. We aim to deal with genuine customer issues fairly and efficiently.
20. Governing Law
These Terms & Conditions are governed by the laws of England and Wales. Any disputes will be subject to the applicable courts of England and Wales, subject to any mandatory consumer rights regarding where legal proceedings may be brought.
