1. Introduction

These Terms and Conditions govern your use of the TCG Wagon website ("the Site") and your purchase of products from us. By accessing the Site and placing an order, you agree to be bound by these Terms. Please read them carefully before using our services. If you do not agree to these Terms, you should not use this Site.

2. About Us

3. Use of the Website

You agree to use this website only for lawful purposes and in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of the website. Prohibited behaviour includes:

• Conduct that is unlawful, fraudulent, harmful or in connection with any unlawful, fraudulent or harmful purpose or activity.
• Transmitting any unsolicited or unauthorised advertising or promotional material (spam).
• Knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful.
• Attempting to gain unauthorised access to the Site, the server on which the Site is stored, or any server, computer or database connected to the Site.

4. Product Information and Pricing

We make every effort to ensure that product descriptions, images and prices on the Site are accurate. However, errors may occasionally occur. If we discover an error in the price of any goods you have ordered, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat the order as cancelled.

All prices are shown in GBP (£) and include VAT at the applicable rate where appropriate. Prices may change at any time, but changes will not affect orders already placed.

5. Orders and Acceptance

All orders are subject to acceptance and availability. When you place an order on our Site, you will receive an order confirmation email. This email is an acknowledgement that we have received your order, not an acceptance of the order. A contract between us is formed only when we dispatch the goods to you and send you a dispatch confirmation email.

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by the same customer account, the same credit card and/or orders that use the same billing and/or shipping address.

6. Payment

Payment for all orders must be made at the time of purchase. We accept all major credit and debit cards, Apple Pay, Google Pay, PayPal, Klarna and Clearpay. All payments are processed securely through our payment providers. We do not store your full payment card details on our servers.

For pre-orders, payment is taken at the time of order to secure your allocation. This ensures we can confirm stock with our suppliers on your behalf.

7. Delivery

Delivery timescales are estimates only and commence from the date of dispatch, not the date of order. We are not responsible for delays outside our control, such as courier delays, customs processing or adverse weather conditions. Risk in the goods passes to you upon delivery.

8. Returns and Refunds

Under the Consumer Contracts Regulations 2013, you have the right to cancel your order within 14 days of receiving the goods and receive a full refund, excluding the cost of return postage (unless the goods are faulty). Items must be returned unopened, in their original condition and packaging.

9. Faulty or Damaged Goods

If you receive goods that are faulty, damaged or not as described, please contact us within 48 hours of delivery with photographs of the damage and packaging. We will arrange a free replacement or full refund, including any return postage costs. Your statutory rights are not affected.

10. Pre-Orders

Pre-order items are products that have been announced but not yet released. Release dates are provided by the manufacturer and are subject to change. If a release date changes, we will notify you by email with the revised date. You may cancel a pre-order at any time before dispatch for a full refund.

Pre-orders are secured on a first-come, first-served basis. Payment is taken at the time of order. We do not guarantee allocation beyond our confirmed stock with distributors.

11. Intellectual Property

All content on this Site, including text, graphics, logos, images, audio clips, digital downloads and software, is the property of TCG Wagon or its content suppliers and is protected by UK and international copyright and intellectual property laws. You may not reproduce, duplicate, copy, sell, resell or exploit any portion of the Site without express written permission from us.

12. Limitation of Liability

To the extent permitted by law, TCG Wagon shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill or other intangible losses, resulting from your access to or use of (or inability to access or use) the Site or our products.

Our total liability to you for any claim arising out of or relating to these Terms or the Site shall not exceed the amount you paid to us for the goods giving rise to the claim.

Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Changes to These Terms

We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Site following any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
